Welcome to Pacific Rentals Pro. These Terms of Service ("Terms") govern your access to and use of our rental property calculator web application and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Pacific Rentals Pro provides a rental property calculator and analysis platform that enables users to:

• Search and analyze rental properties across the United States
• Calculate investment metrics including cap rate, NOI, DSCR, and cash-on-cash return
• Access property data, rental estimates, and mortgage rate information
• Save and manage property search history
• Share property analysis with others via time-limited links

3. Account Registration

3.1 Account Creation

To access certain features of the Service, you must create an account. You can register using:

• Email with One-Time Password (OTP) verification
• Google OAuth authentication
• Other social login providers as they become available

3.2 Account Responsibilities

You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.3 Age Requirement

You must be at least 18 years old to create an account and use the Service.

4. Subscription Plans and Billing

4.1 Free Trial

New users receive a limited free trial with restricted access to property searches and features. Trial limitations are displayed within the Service.

4.2 Paid Subscriptions

We offer paid subscription plans (Starter and Pro) with different feature levels. Subscription details, pricing, and billing cycles are displayed on our Pricing page.

4.3 Payment Processing

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

4.4 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• We do not provide prorated refunds for partial billing periods
• Refund requests for exceptional circumstances will be reviewed on a case-by-case basis

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any laws
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service without permission
• Redistribute, resell, or commercially exploit Service data without authorization
• Impersonate another person or entity
• Upload malicious code or content
• Harass, abuse, or harm other users

6. Intellectual Property

6.1 Our Content

The Service, including its design, features, and content, is owned by Pacific Rentals Pro and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

6.2 Third-Party Data

Property data is sourced from third-party providers (ATTOM, Rentcast, FRED). This data is subject to their respective terms and may not be redistributed.

6.3 Your Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a license to use, display, and store it as necessary to provide the Service.

7. Third-Party Services

Our Service integrates with third-party services including:

• Google (Maps, Street View, OAuth authentication)
• Stripe (payment processing)
• Radar (address autocomplete)
• Property data providers (ATTOM, Rentcast)

Your use of these integrations is subject to their respective terms of service and privacy policies.

8. Disclaimers

8.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 Data Accuracy

While we strive to provide accurate property data and calculations, we do not guarantee the accuracy, completeness, or reliability of any information provided through the Service. Property values, rental estimates, and investment metrics are approximations and may differ from actual figures.

8.3 Investment Decisions

We are not financial advisors. The Service is a tool to assist with property analysis, not professional investment advice. You are solely responsible for your investment decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACIFIC RENTALS PRO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Pacific Rentals Pro, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Any other reason at our discretion with reasonable notice

You may terminate your account at any time by contacting us or through your account settings.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property matters.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
