These Terms of Service (“Terms”) govern your access to and use of Pacific Rentals Pro (“the Service”), operated by Pacific Rentals Pro (“we,” “us,” or “our”) at pacrent.io. By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems.
  • Interfere with or disrupt the Service or the servers and networks that host it.
  • Scrape, crawl, or use automated means to extract data from the Service beyond normal use of its features.
  • Resell, redistribute, or sublicense access to the Service without our written consent.

4. Subscriptions and Payments

  • The Service offers free and paid subscription plans. Paid plans are billed on a recurring monthly or annual basis.
  • Prices are subject to change with 30 days' notice. Existing subscribers will be notified before any price change takes effect on their next billing cycle.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

5. Property Data and Accuracy

The Service provides property data, rental estimates, and financial projections sourced from third-party providers including the Rentcast API. While we strive for accuracy:

  • Data is provided “as is” and may not reflect the most current market conditions.
  • Estimates are not appraisals. Rental estimates, property valuations, and financial projections are for informational purposes only and should not be relied upon as the sole basis for investment decisions.
  • We do not guarantee the accuracy, completeness, or timeliness of any data provided through the Service.
  • You are responsible for conducting your own due diligence before making any investment decisions.

6. Not Financial or Tax Advice

The Service is a tool for property analysis and portfolio management. Nothing in the Service constitutes financial, investment, tax, or legal advice. Information regarding Real Estate Professional (REP) status, tax deductions, and financial projections is provided for informational purposes only. Consult a qualified professional before making financial or tax decisions.

7. Intellectual Property

  • The Service, including its design, code, features, and content, is owned by Pacific Rentals Pro and protected by intellectual property laws.
  • Your data remains yours. We do not claim ownership of the property data, financial information, or other content you enter into the Service.
  • We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your subscription.

8. Limitation of Liability

To the maximum extent permitted by law, Pacific Rentals Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or investment returns, arising out of or related to your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request an export of your data prior to account termination.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
